Terms of Use – Josine van der Knoop (Coach Josine)

These are the terms and conditions of Josine van der Knoop (Company), located in 465 Midland Ave, Rye, New York 10580 and operates under her own name.

Article 1. Definitions

1.1. Josine van der Knoop (Company) is the user of these terms and conditions and the party selling you an online course.
1.2. You are a customer of Josine van der Knoop (Company) and a participant in the course.
1.3. We (Josine van der Knoop (Company) and you) are entering into an agreement that sets out the arrangements regarding the course you purchase from Josine van der Knoop (Company).
1.4. In writing includes not only traditional paper correspondence but also communication via email, WhatsApp, and other messaging services.
1.5. Course includes courses, masterclasses, training, and any other online services.

Article 2. Applicability of these Terms and Conditions

2.1. These terms and conditions are part of the agreement between you and Josine van der Knoop (Company).
2.2. If you use your own terms and conditions, they are hereby expressly rejected. Only these terms and conditions apply.
2.3. Deviations from these terms are valid only if both parties agree in writing.
2.4. If any provision in these terms is not legally permitted, it will be disregarded; the remaining provisions remain in force.
2.5. Josine van der Knoop (Company) may amend these terms unilaterally. You will receive the updated version. If the changes significantly affect your rights, you may terminate the agreement.

Article 3. Formation and Duration of the Agreement

3.1. An agreement is formed when an offer is accepted. By purchasing a course in the webshop, an agreement is established.
3.2. During checkout, you agree to these terms, which form part of the agreement.
3.3. Obvious errors or mistakes in offers do not bind Josine van der Knoop (Company).
3.4. The most current offers are listed on the website. A price offered earlier does not guarantee the same price later.
3.5. The agreement’s duration depends on the type of course: for lifetime access, it’s indefinite; for time-limited courses, the rental period stated at purchase applies.

Article 4. Price and Payment

4.1. Prices are stated on the website and are exclusive of GST.
4.2. Once you complete your purchase, you are obligated to pay the full course price.
4.3. If you pay in installments and miss a payment, access may be temporarily suspended until payment is made.
4.4. Misuse of discount codes will result in being charged the discount amount plus $55 in administration fees. Access will be revoked until payment is complete.
4.5. Late payments incur statutory interest and collection fees as per US law.
4.6. All reasonable legal and extrajudicial collection costs are your responsibility.
4.7. If you go bankrupt, receive a suspension of payment, liquidate your business, or are subject to seizure, all claims become immediately due, and access may be revoked if payment is incomplete. Fully paid courses remain accessible.

Article 5. Mutual Obligations

5.1. Josine van der Knoop (Company) aims to help you achieve your goals but does not guarantee specific results. Obligations are best-effort, not result-based.
5.2. Your own effort, actions, and input are essential for success.
5.3. You must provide complete, timely, and truthful information when requested. Extra costs from failing to do so will be charged to you.
5.4. You remain responsible for your own actions and decisions.
5.5. Josine van der Knoop (Company) may involve third parties to fulfill parts of the agreement.
5.6. As you receive instant access to course content, fulfillment occurs at the moment access is granted. Bonuses and extras have no standalone value and are not refundable.

Article 6. Termination of the Agreement

6.1. Josine van der Knoop (Company) may terminate the agreement and revoke access if deemed necessary due to a disrupted relationship, without compensation.
6.2. Breaching the agreement (including these terms) may lead to access being revoked and exclusion from future courses, without refund.
6.3. Josine van der Knoop (Company) may cease offering a course and remove content without compensation.
6.4. For some courses, you may cancel within 7 or 14 days, depending on the course. You may be asked to show proof of participation. Send cancellations to [email protected].
6.5. After 14 days, if you’re a private consumer, prorated refunds may apply depending on content already provided. Bonuses hold no separate value.
6.6. If you are a business customer, cancellation is no longer possible after the initial 7 or 14-day period.
6.7. Bankruptcy, suspension of payment, or liquidation allows both parties to terminate immediately without court involvement.

Article 7. Intellectual Property Rights

7.1. All course content belongs to Josine van der Knoop (Company). You receive a license to use it for the agreed duration.
7.2. You may not publish, share, reproduce, copy, or modify the content; it’s for personal use only.
7.3. Content includes videos, texts, transcripts, ebooks, masterclasses, recordings, private social media posts, etc.
7.4. Infringement includes: (i) using content for other purposes, (ii) reusing content without permission, (iii) copying or modifying content.
7.5. Copyright violations incur a fee of 3 times the current course price, without prejudice to additional damage claims.

Article 8. Liability

8.1. Josine van der Knoop (Company) is only liable if failure is due to gross negligence or intentional misconduct.
8.2. Liability is limited to direct damages; indirect damages (e.g., lost profits, missed savings, emotional damage) are excluded.
8.3. Liability is capped at the contract value or the amount paid by the insurer, whichever is applicable.
8.4. You must first notify Josine van der Knoop (Company) of the issue (formal notice of default) and allow reasonable time to resolve it before liability arises.
8.5. This liability limitation does not apply to intentional misconduct or gross negligence.
8.6. You are responsible for providing accurate, complete, and timely information.
8.7. You indemnify Josine van der Knoop (Company) from third-party claims related to course content.

Article 9. Force Majeure

9.1. Force majeure may prevent fulfillment of obligations. Josine van der Knoop (Company) will notify you as soon as possible.
9.2. In such cases, performance is suspended for the duration of the force majeure.
9.3. If force majeure lasts longer than one month, both parties may terminate the agreement without further obligations.
9.4. Force majeure includes but is not limited to: pandemics, illness, government measures, (civil) war, riots, terrorism, fire, water damage, flooding, strikes, and supplier failures.

Article 10. Practical Course Details

10.1. Josine van der Knoop (Company) uses third-party software for course delivery and cannot guarantee continuous availability.
10.2. Course content may be modified, expanded, or limited at any time.
10.3. Access is personal and valid for one user account. Group access requires a custom arrangement.
10.4. Josine van der Knoop (Company) may deny access if prior payments are outstanding.
10.5. You may not copy course materials. If suspected, you must prove otherwise.
10.6. You may not create a similar course within 12 months of starting.
10.7. Sharing screenshots with credit is allowed, but excessive sharing or screen recordings are prohibited.
10.8. Lifetime access means as long as Josine van der Knoop (Company) exists or until the course is taken offline.
10.9. You are responsible for timely completion and saving materials; missing access later is at your own risk.
10.10. Contributions to community forums must not include spam, advertising, or unwanted content.
10.11. You will be informed in advance if a course will be discontinued to allow sufficient time to complete or download content.

Article 11. Complaints

11.1. Complaints must be reported within 14 calendar days of gaining access to the course.
11.2. Complaints must be submitted by email to [email protected], including justification.
11.3. Josine van der Knoop (Company) reserves the right to correct any defect.
11.4. Filing a complaint does not suspend your payment obligation.

Article 12. Content Disclaimers

12.1. Josine van der Knoop is a Parent Coach. All information in the courses are for informational purposes only and is not a replacement for medical advice from a physician, pediatrician or therapist. Please consult with a professional if you suspect any medical or developmental issues with your child.

12.2 The information does not replace the relationship between therapist and client in a one-on-one treatment session with an individualized treatment plan based on their professional evaluation.  

12.3 The information provided in the courses is provided “as is” without any representations or warranties, express or implied.

12.4 Do not rely on the information as an alternative to advice from your medical professional or therapist. You should never delay seeking medical advice, disregard medical advice, or discontinue medical treatment as a result of any information provided.  

Article 13. Final Provisions

13.1. All shared information will be kept confidential.
13.2. US law applies to this agreement.
13.3. Disputes will first be handled amicably. If unresolved, they will be submitted to the competent court where Josine van der Knoop (Company) is located, unless the law dictates otherwise.
13.4. Claims against Josine van der Knoop (Company) expire after one year.
